Casino Rama, and all casinos in the province, were shut down in mid-March by Ontario Lottery & Gaming. Many of the smaller casinos have reopened over the past several weeks. However, Gateway noted it didn't make financial sense to reopen a large facility like Casino Rama when only 50 people - including staff - could be inside the building at any time.


When it was announced last week that Casino Rama was making plans to reopen, it was going to be on a very limited basis, by invitation-only. While some casinos in Ontario are reopening this morning, the doors remain locked at Casino Rama.


However, the operator of the gambling facility east of Orillia received some good news recently.


On Friday, Gateway Casinos and Entertainment became the first Canadian employer to receive a loan from the Canada Enterprise Emergency Funding Corp. (CEEFC) under its Large Employer Emergency Financing Facility (LEEFF).


The agreement provides Gateway with access to $200 million of liquidity.


“These funds will provide us with capital to support restarting our operations and returning people back to work when it is safe and viable to do so,” Gateway CEO Tony Santo said in an email to employees.


He noted the pandemic “hit our employees and their families and communities hard” and said the company is “appreciative of the LEEFF program.”


He said the loan is a shot of good news amid months of dire news.


“Back in the spring, we believed that this shutdown would be for a few weeks,” said Santo of the government shutdown of casinos on March 16 due to the COVID-19 pandemic.


“However, we have now seen that the closure has lasted far longer and there is continued uncertainty about how long the shutdowns will stretch.”


That uncertainty has been taxing for employees, says Corey Dalton, president of Unifor Local 1090, which represents employees at Casino Rama and Gateway Casino in Innisfil.


“After being off of work for more than six months, all of our casino members are struggling financially at this point,” Dalton told OrilliaMatters.


Unifor Local 1090 and Gateway recently negotiated an agreement that extended health benefits for unionized employees until the end of September, he said.


The new LEEFF funding prompted Gateway to extend benefits for all members until Oct. 31, at which point they will review benefits again.


“We are extremely grateful and applaud Gateway for this decision,” said Dalton.


Another key component of the agreement included the opportunity for members to enrol in a "paid inactive leave" program that would provide members with ongoing financial support through the Canada Emergency Wage Subsidy (CEWS) program.


“The paid inactive leave program has been very beneficial for a large amount of our members,” said Dalton. “Unfortunately, this program was scheduled to expire on Sept. 26. Late last week, the federal government indicated that they would be extending CEWS into 2021. We now anxiously await important details from the federal government on the extension and any limitations the program may have.”


Dalton said employees are eager to get back to work. An August poll of members concluded 70% of unionized Casino Rama employees were "comfortable to return to work if safety precautions are implemented."


Dalton said provincial regulations handcuff casino operations.


“The Ontario government has placed extensive restrictions on casinos,” he said, noting table games are currently prohibited from reopening and all casinos are limited to a maximum of 50 guests.


“Both the Union and the employer have asked the Ontario government to review this cap,” said Dalton.


“Local 1090 maintains a strong belief that the guest-limit needs to be proportionate to the physical size of each casino. Casino Rama has one of the largest gaming floors in Ontario in terms of square footage - there is an ability for Gateway to provide safe, physical distancing for a larger number of patrons than other facilities which can be 20% (or even less) of the square footage,” Dalton explained.


Santo agreed, saying the “50-customer capacity limit . makes reopening very challenging.”


Santo said they “have developed extensive health and safety plans corporately and for each of our sites. These plans include two metres physical distancing, the installation of Plexiglas for areas of frequent employee/guest interactions, rigorous cleaning measures and the mandatory use of masks or face coverings for all individuals entering the gaming sites.


“Our health and safety standards have been reviewed by external subject matter experts and they have been proven to be successful through the re-opening of select food and beverage outlets across the company,” he said.


“Despite our detailed plans that well exceed the protocols and oversight in every other area of the economy, there is no sound science to support why we are not allowed to open while big-box stores, restaurants and gyms are allowed to re-open,” Santo explained.


“We operate in a highly regulated sector and are already accustomed to following government-mandated parameters," noted Santo. "We have complete confidence that our operations and our employees can safely and successfully operate under these added health and safety protocols.”


He said Gateway is “continuing to appeal to the appropriate government agencies in all provinces to allow us to re-open our operations in a safe and viable way.”


At 10 a.m. this morning, the 11 properties operated by Great Canadian Gaming Corporation (GCGC) re-opened. At each of these sites, guests are required to reserve a two-hour gaming time-slot.


Caesars Windsor will be re-opening on Oct. 8 by invitation only. All other Ontario casinos remain closed.

Almost a year after Casino Rama was shut down due to the pandemic, there remains “no set timeline” for its reopening.


And according to an internal memo sent to employees this week, there are plans afoot to “refresh” the casino’s gaming floor.


“At Casino Rama we will be using the continued closure time to refresh our gaming floor,” notes a memo sent to employees by the casino’s operator, Gateway Casinos and Entertainment.


“The changes will include reconfigurations of the slot and table floors as well as refreshing slot product.


“The new floor design will also be better aligned with the volumes we were experiencing prior to closure,” notes the memo.


Corey Dalton, the president of Unifor Local 1090, says the “refresh” will see the removal of about 400 slot machines and 20 table games.


However, he said “there will not be an alteration to staffing levels” at the gambling facility east of Orillia.


“There were 1,050 Unifor members before the pandemic,” Dalton said. “The reconfiguration of the floor (and the removal of the slots and tables) is not expected to have any impact on staffing levels.”


He said “these machines and tables were considered to be excess before the pandemic; most were rarely used, if ever.


“The size of the workforce is already proportionate to Gateway's expected market demand at reopening. They have expressly advised Unifor Local 1090 reps that they have no plans for additional reductions to staff levels,” he said.


Rob Mitchell, director of communications and public affairs for Gateway, said the union leadership has been involved in the process.


“The work is being done by Gateway's corporate slots team, who are responsible for all gaming floor projects at all Gateway sites in Ontario. The union has been notified of the renovations and are fully aware of the project and have been actively involved in the recall of staff who are working on the refresh,” said Mitchell.


“While the gaming floor is in part being reconfigured to better align with the new landscape created by increased competition within the gaming industry across the province, we also believe the refresh will improve the customer experience.


“The new layout will provide customers better access to their favourite games and allow guests to more easily navigate the gaming floor. The present refresh was in the planning stages even prior to the COVID-19 pandemic, as business volumes did not warrant the number of machines we had in operation at the Rama location," Mitchell explained.


“The new design of the gaming floor aligns with the layout and gaming variety we successfully employ at other Gateway Casinos in the province that has proven very popular with our patrons,” said Mitchell.


He echoed Dalton’s sentiments about the impact on employees. “There are no anticipated impacts to staffing as a result of the redesign,” said Mitchell.


Dalton said the lengthy closure has been tough on employees. (Casino Rama was ordered closed by the OLG on March 16, 2020).


“Nearly every casino worker in Canada has been off work for more than 11 months,” said Dalton. “The hospitality and gaming sector has been crippled by the effects of COVID-19.


“The financial impacts of being off work for nearly a year will take an incredible toll on any worker,” he said.


Union workers have also been out of work, noted Orillia’s Tshweu Moleme, a Unifor rep at Casino Rama.


“I can assure you that Rama union leadership has been working very hard, alongside our Local and Unifor’s national leadership, during this pandemic,” said Moleme.


“We are also out of work, like millions of Canadians, but we continue to put in hours of our own time into making sure that Rama workers will return to a safe workplace and that they will have jobs to return to.”


He noted businesses also have rights.


‘We expect that such rights won’t be abused and that our Rama members will be able to return to their jobs once time allows and it is safe to do so,” said Moleme. “Our membership can’t wait to return to work and deliver some of the best customer service in the country.”


Dalton noted the union has fought to maintain benefits for unionized employees and said full benefits will remain in place for unionized employees until the end of March. And partial benefits have been guaranteed until at least June 30.


As of April 1, a reduced benefit plan will be enacted; that will include full prescription drug coverage and life insurance.


However, workers will, temporarily, lose their dental, vision and paramedical coverage.


When members return to work, full benefits will be restored.


As for a potential reopening date, that remains unclear.


“Gateway has not shared any planned opening dates,” said Dalton, noting re-opening is subject to approval from multiple entities including Gateway, OLG, Rama First Nation, Public Health officials.


Mitchell said it’s not clear when Casino Rama might reopen to the public.


“No decision on re-opening has been made at this time as we continue to monitor COVID infection numbers in the region,” he said.


“We will only re-open with the approval of Rama First Nations working in conjunction with local public officials and the visitation limitations prescribed by the provincial government.”

Getting There

On November 10, 2016, Casino Rama announced that it was informed on November 4, 2016 that its internal computer network was subjected to a cyberattack in which confidential data of employees, customers and vendors was stolen. Some of Casino Rama’s affected customers and employees received an email from Casino Rama advising of the privacy breach. The statements posted on Casino Rama’s website can be viewed here.


2. On November 14, 2016, Charney Lawyers PC and Sutts, Strosberg LLP (now Strosberg Sasso Sutts LLP) commenced a proposed national class action on behalf of Casino Rama employees (past and present), customers and vendors for damages arising from the privacy breach. The plaintiffs also seek damages on behalf of members of the Ontario Lottery and Gaming Corporation’s Self-Exclusion Program whose personal information was provided to Casino Rama by the Ontario Lottery and Gaming Corporation (OLG).


3. In the action, the plaintiffs assert that the defendants were negligent and that Casino Rama breached its Privacy Policy by failing to take reasonable security measures to protect against unauthorized access to class members’ personal and confidential information.


4. The proposed class consists of all persons residing in Canada, excluding the defendants and the defendants' executives, whose personal information was collected by Casino Rama, or was provided to Casino Rama by the OLG, and was then stolen or accessed in the breach.


5. The defendants are Casino Rama Services, Inc., the OLG, CHC Casinos Canada Limited and Penn National Gaming, Inc..

According Casino Rama’s statements, an anonymous hacker claims to have stolen confidential employee information from 2004 to 2016 including performance reviews, payroll data, terminations, social insurance numbers and dates of birth. Casino Rama also stated that the hacker claims to have stolen other confidential information from 2007 to the present, including the Casino Rama’s IT information, hotel and casino financial reports, security incident reports, email, customer credit inquiries, collection and debt information and vendor information and contracts. Some of the stolen information was published on the internet and the hacker has threatened to publish more of the stolen information.


7. Casino Rama stated that the privacy breach was reported to the Privacy Commissioner of Canada and the Information and Privacy Commissioner of Ontario. On November 10, 2016, the Information and Privacy Commissioner of Ontario posted a statement advising that it has launched an investigation. The statement may be viewed here. Casino Rama has also reported that it is working with the Ontario Provincial Police, the Royal Canadian Mounted Police, the OLG and the Alcohol and Gaming Commission of Ontario to address the issue.


8. On May 10, 2017, Justice Belobaba of the Superior Court of Justice in Toronto ordered that carriage of the proposed class action be granted to the plaintiffs represented by Charney Lawyers PC and Strosberg Sasso Sutts LLP who have served a motion record for certification of the proposed class action. A separate class action concerning the Casino Rama privacy breach, commenced by Flaherty McCarthy LLP in Oshawa, has been stayed. Plaintiffs’ counsel will now schedule the hearing of their motion for certification of the proposed class action.


9. Anyone who received a notice of the privacy breach from Casino Rama or who believes their private information may have been compromised is urged to immediately notify their banks and credit card companies and to monitor their accounts for suspicious activities. Affected individuals may also contact a credit bureau such as TransUnion Canada or Equifax to determine whether there have been any unauthorized transactions on their accounts to explore options to purchase credit protection services.


10. If you were an employee, customer or vendor of Casino Rama who provided confidential information to Casino Rama as early as 2004 or if you received Casino Rama’s notice of the privacy breach, please provide the information requested on our Communication page to indicate your interest in the class action and to receive updates about the class action, especially if there is a settlement or award of damages.


11. The motion to certify this action as a class action will be heard on November 6, 7 and 8, 2018 in Toronto.
